DUI - The First 10 Days

The citation is also a 10-day driving permit. Formal review, waiver review, or a hard suspension — you have to choose.

Your first important decision comes only 10 days from the date of your arrest. The citation notices the impending license suspension and operates as your driving permit for those 10 days.

Do nothing and you face a 30-day hard suspension if you blew above .08, or 90 days if you refused a sample. Request a Formal Review Hearing for a 42-day permit and a chance to invalidate the administrative suspension. Or request a waiver review for immediate hardship reinstatement.

The criminal case is a second track: the State must prove impairment or a .08-or-above alcohol level beyond a reasonable doubt.
